Stryker Hip Replacement Recall News: Rottenstein Law Group Responds to Judge's Recommendation for Mediation in New Jersey Stryker Hip Lawsuits

Earlier this month, a judge recommended that Stryker hip lawsuits consolidated in New Jersey in January should go through mediation, according to court documents for New Jersey MCL-296. The Rottenstein Law Group, which operates the comprehensive Stryker Hip Replacement Recall Center, has been actively monitoring updates regarding metal-on-metal hip replacement lawsuits and trials.



 

Judge Brian R. Martinotti is overseeing the 50 Stryker lawsuits consolidated in Bergen County, which plaintiffs’ attorneys deem ideal because of the judge’s familiarity with medical cases, including those arising from metal poisoning, which is one of the serious, alleged side effects of Stryker Rejuvenate and ABG II, according to court documents for New Jersey MCL-296.



“Mediation has the potential for an efficient resolution for these cases,” said Rochelle Rottenstein, principal of the Rottenstein Law Group, which is accepting clients in Stryker hip recall lawsuits. “These first mediation sessions could be a window into how future mediation of lawsuits would transpire. If mediation is better for all parties compared to litigation, then that could be how future lawsuits will be decided. If mediation seems to be ineffective, then it would mean a return to litigation. It resembles a ‘bellwether’ arrangement, similar to the bellwether trials we have seen with other medical devices.”
